1. Acceptance of Terms
By creating an account or using any part of the Optinex AI platform, you agree to these Terms of Service and our Privacy Policy. If you are using our services on behalf of an organization, you represent that you have authority to bind that organization to these terms. If you do not agree to these terms, you may not access or use our services.
2. Description of Services
Optinex AI provides a Generative Engine Optimization (GEO) platform that helps brands track, analyze, and optimize their visibility in AI-generated search responses. Our services include AI search visibility monitoring across multiple models, competitor analysis and benchmarking, content optimization recommendations, prompt tracking and analysis, source citation monitoring, and strategy generation. Features may vary by subscription plan.
3. Account Registration
To use our services, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these terms.
4. Subscription and Billing
Our services are offered on a subscription basis with various plans. Prices are as listed on our website and may change with 30 days' notice. Subscriptions auto-renew unless cancelled before the renewal date. Refunds are provided in accordance with our refund policy. You are responsible for all applicable taxes. We accept major credit cards and process payments securely through our payment providers.
5. Acceptable Use
You agree not to use our services to violate any laws or regulations, infringe on intellectual property rights, transmit malware or harmful code, attempt to gain unauthorized access to our systems, scrape or extract data beyond what is permitted, resell or redistribute our services without authorization, harass, abuse, or harm others, or interfere with the operation of our platform. We reserve the right to suspend access for violations.
6. Intellectual Property
The Optinex AI platform, including its software, design, logos, and content, is owned by Optinex AI and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use our services. You retain ownership of all data you upload or generate through the platform. You grant us a limited license to process your data solely to provide our services.
7. Data and Privacy
Your use of our services is also governed by our Privacy Policy. You agree that we may collect and process data as described therein. You are responsible for ensuring that any data you provide complies with applicable data protection laws and that you have obtained necessary consents.
8. Disclaimers
Our services are provided 'as is' and 'as available' without warranties of any kind, whether express or implied. We do not guarantee that AI search visibility metrics will lead to specific business outcomes. AI model responses and rankings may change at any time and are outside our control. While we strive for accuracy, we do not warrant that our analytics or recommendations will be error-free.
9. Limitation of Liability
To the maximum extent permitted by law, Optinex AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of or inability to use our services. Our total liability shall not exceed the amount paid by you in the twelve months preceding the claim.
10. Termination
You may cancel your account at any time through your account settings. We may terminate or suspend your access for cause, including violation of these terms, with or without notice. Upon termination, your right to use our services ceases immediately. We will retain your data for 30 days after termination, after which it will be deleted unless retention is required by law.
11. Governing Law
These terms are governed by the laws of the jurisdiction in which Optinex AI is incorporated, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration, except where prohibited by law. You agree to submit to the personal jurisdiction of the courts in our jurisdiction for any actions not subject to arbitration.
12. Changes to Terms
We may modify these terms at any time. Material changes will be communicated via email or through the platform at least 30 days before taking effect. Continued use of our services after changes take effect constitutes acceptance of the updated terms.
